Open letter to individuals, groups, organizations, parties who struggleagainst imperialism, for defending the rights of the people masses and forthe new birth of the communist movementDear comrades, on 5th November in Ancona (Italy) it will be held the preliminary hearingfor the Tenth Judiciary Proceeding the Italian Authorities framed up againstthe "caravan" of the (new) Italian Communist Party. The public prosecutorMarco Pucilli of Ancona leads the inquiry. Comrades of the Party of theCommittees to Support Resistance -for Communism (P- CARC) and of theAssociation for Proletarian Solidarity (ASP) are charged with "slanderingthe Public Prosecutor Paolo Giovagnoli", because they called him with histrue name, the "new Torquemada".The judiciary proceeding the Public Prosecutor Marco Pucilli frames up goeswith the appeal to the Supreme Court the judge Giovagnoli did against the"non - suit" judgement of the Judge for the Preliminary Hearings RitaZaccariello on 1st July. Also the General Attorney of Bologna did an appealas regards the matter, and this is a deed absolutely exceptional andextraordinary.This attack brings into question all Communists' freedom of politicalactivity. It is an attack to the entire communist movement of our country,to all opponents, to all the people who rebels and struggles against theBerlusconi's gang, the Vatican and US imperialists for defending the rightsof people's masses, for conquering other ones and breaking up once and forall the capitalist system and building a world led by workers.Communists' persecution is the core of the struggle between people's massesand imperialist bourgeoisie: only the Communists who act as true Communistsare able to direct the working class and the other people's masses in thestruggle for breaking up the present state of things and establishingsocialism, that is the only other possible world.The persecution of Communists in Italy, and particularly the persecutionagainst the caravan of the (new)PCI, is an operation aimed to prevent thepeople's masses from defending themselves facing the attack the imperialistbourgeoisie moves against their rights, their conquests and also theirelementary vital needs, the more the present crisis goes on. It is anoperation aimed to transform this defence in attack, in struggle for makingthe revolution in an imperialist country.The imperialist bourgeoisie does not let to the people's masses either theright to defend themselves. What happened at Rome some days ago testifiesit. For many weeks in Italy a movement for defending the State education,involving millions of people, is going on. At Rome, in Navona Square, peoplewere demonstrating for defending State education. The police let enter acamion of fascists, armed with beats and bars, and let them go wild againstthe protesters. It intervened only when the protesters organized themselvesand counter-attacked. So it is for decades against the caravan of the(n)PCI, because for decades it has worked for organizing people's massesstarting from the defence of their interests, for making Italy a newsocialist country.An international answer to this repressive attack is important, because itmeans to defend the rights the Resistance against Nazi fascism conquered,and these conquests belong also to the international communist movement,because their importance goes beyond Italian borders.An international answer to this umpteenth attack is even more of a defenceof our patrimony. Fax or message to be sent To the Judge for Preliminary Hearings Paola Murreddu of Anconafax 0039 (0)71.50.62.252 ,e-mail: procura.ancona@giustizia.it We undersigned ... formally protest against the persecution the Italianmagistracy carries out against the dissent, the freedom of expression andassociation.In particular, the Public Prosecutor Giovagnoli continuously utilizesclearly political crimes, introduced in our order by fascism, as that ofsubversive association and against Communist political organizations (i.e.the trial against the (new) Italian Communist Party and the Party of theCommittees to Support the Resistance - for Communism) and against members ofthe movement of protest of Bologna (i. e. the movement for the selfreduction of the university catering and of the cinema charged of subversiveactivity for having occupied a university room and for some protests at thetown council).While Giovagnoli persecutes as "terrorists" Communists and students guiltyfor having occupied a classroom, the impunity is guaranteed to the onesresponsible for the most ferocious deeds at Genoa in 2001 (beatings,tortures, and the killing of Carlo Giuliani), and, besides, there have beenthe hardest requests of condemnation for the people who demonstrated at theG8, the requests of condemnation for Rebel South, the inquiries against theSlai Cobas for class trade union and the preventive dismissals against thestruggle vanguards (Fiat SATA of Melfi and Fiat of Pomigliano).The attempt to use the scarecrow of "terrorism" for these attacks onCommunists and on people who protest brings us back sad memories, whenMussolini and who supported him firstly outlawed Communists and theneliminated every party and the Parliament itself, when the fascists werecalling "bandits" the Partisans (most of whom were Communists) who fought tofree Italy from Nazi-fascism.The many judiciary inquiries against who has worked for the (n)PCI, againstthe CARC Party, the Association for Proletarian Solidarity and theirsympathizers and helpmates are a clear violation of any democraticprinciple. They are an attempt, by now no more too much concealed, to outlawCommunism.The charge of "slandering" on the ASP and CARC Party militants by Giovagnoliis clearly used as a pretext and threatening. With his enquiry for"subversive association" against this political area for five years, hecarried out a systematic work of slandering. In addition, after the non-suitdid by the Judge for Preliminary Hearings Rita Zaccariello of Bologna, asthere were no evidences, he made an appeal to the Supreme Court, soconfirming his hatred against Communists, and that he is really a new"Torquemada".So I send this fax for protesting and express my indignation and also myconcern for the reactionary and persecutory work Giovagnoli and the BolognaAttorney are heading, attacking the fundamental principles of the ItalianConstitution regarding the freedom of association and politicalorganization.I invite the association Democratic Magistracy, which Giovagnoli belongs to,to declare its opinion against this anti democratic drift.The preliminary hearing that will be held at Ancona against 4 Communists isa serious deed, that has to be strongly rejectedSo we ask the Judge for Preliminary Hearings Paola Murreddu not to supportand to strengthen the reactionary work the Judge Giovagnoli is carrying out......./....../
