At a hearing in May 2010 Judge Danilo Augusto KANTHACK Paccini ordered repossession Area Canaan (ancient farms "Only Cocoa" and "at"), where 100 children live, work and study with dignity. John Arnold Tucci and a group of French who live in Sao Paulo - recipients of the judge - are squatters on public land. The document that they have is a CATP - Lease of Public Lands, which gives no right to land ownership, only the right to use. Thing they did, because when the farmers arrived in the cocoa area was totally abandoned. CATP with the owners who say they still managed to bank financing. Not only that, the squatters are also timber thieves. Practically all the wood from the forest of Canaan was stolen by them. In 2006, farmers were still camped, witnessed three truckloads of wood leaving the Canaan area. The fourth truck was arrested by the peasants before leaving. After a few days Incra was not until the camp to investigate the theft of timber or defend the peasants but to try to save the truck from land grabbers and thieves of wood. This is not new to us. In April this year Incra did a survey in the Canaan area and saw with his own eyes the whole production, buildings and improvements made by the peasants. Despite this the Incra and the national agrarian ombudsman Gercino Joseph said nothing they can do for farmers. It was expected, because only the letters that they do is in practice not solve anything. Illegal occupation of public lands, timber theft and gunmen are common crimes among the landowners of Rondonia. But they need not worry because the judge Danilo Paccini in Rondonia and many others are there to cover for them and defend them. At the hearing on May, Danilo Paccini was seen talking privately with Dr. Nelson, a retired judge who is reputed to be one of the most corrupt judges of Rondonia. One of his crimes would be falsification of documents held by landowners and squatters in the office notes of his wife in Cacaulândia. A legal output is that farmers are the judge Danilo Paccini decline jurisdiction. This is a technical legal term which means the judge aware that it has jurisdiction over the case and send it to the federal courts. This case would be dismissed as the resumption of the area for Incra and during the peasants would not be evicted. As has previously denounced long ago Danilo Paccini chasing peasants fighting for the sacred right to land. So he will not decline jurisdiction if there is a lot of pressure. The union and action of the population and Jaru Ariquemes and truly democratic movements and people can force the judge. The peasants are cognizant of their rights and the justness of their struggle. They are not willing to lose everything they have built, are not willing to go to town, sour unemployment and hunger and to see their young people fall into drugs. They will resist until the last consequences. Is in the hands of Judge Danilo Paccini prevent another conflict over land in Rondonia. Numa audiência em maio de 2010 o juiz Danilo Augusto Kanthack Paccini decretou a reintegração de posse da Área Canaã (antigas fazendas “Só Cacau” e “Arrobas”), onde 100 famílias vivem, trabalham e estudam com dignidade. João Arnaldo Tucci e um grupo de franceses que moram em São Paulo – os beneficiários do juiz – são grileiros de terras públicas. O documento que eles possuem é um CATP – Contrato de Aluguel de Terras Públicas, que não dá direito à posse da terra, apenas o direito ao uso. Coisa que eles não fizeram, pois quando os camponeses chegaram na Área o cacaueiro estava totalmente abandonado. Com o CATP os que se dizem proprietários ainda conseguiram financiamentos bancários.
Como se não bastasse, os grileiros também são ladrões de madeira. Praticamente toda a madeira da mata do Canaã foi roubada por eles. Em 2006, os camponeses que ainda estavam acampados, presenciaram três caminhões carregados de madeira saírem da Área Canaã. O quarto caminhão foi preso pelos camponeses antes de sair. Depois de alguns dias o Incra foi até o acampamento não para investigar o roubo de madeira nem defender os camponeses e sim para tentar salvar o caminhão dos grileiros e ladrões de madeira. Isto não é novidade para nós.
Em abril deste ano o Incra fez uma vistoria na Área Canaã e viu com os próprios olhos toda a produção, construções e benfeitorias feitas pelos camponeses. Apesar disto o Incra e o ouvidor agrário nacional Gercino José disseram que nada podem fazer pelos camponeses. Já era de se esperar, pois só o que fazem é ofícios que na prática não resolvem nada.
Grilagem de terras públicas, roubo de madeira e pistolagem são crimes comuns entre os latifundiários de Rondônia. Mas eles não precisam se preocupar, pois o juiz Danilo Paccini e muitos outros em Rondônia estão aí para acobertá-los e defendê-los.
Na audiência de maio, Danilo Paccini foi visto conversando reservadamente com o Dr. Nelson, um juiz aposentado que tem fama de ser um dos juízes mais corruptos de Rondônia. Um de seus crimes seria a falsificação de documentos de posse de latifundiários e grileiros no cartório de notas de sua esposa em Cacaulândia.
Uma saída jurídica que os camponeses têm é o juiz Danilo Paccini declinar competência. Este é um termo técnico jurídico que significa o juiz reconhecer que não tem competência para julgar o processo e mandá-lo para a justiça federal. Neste caso, seria julgado a retomada da área para o Incra e durante o processo os camponeses não seriam despejados.
Como já denunciamos anteriormente, há muito tempo Danilo Paccini persegue os camponeses que lutam pelo sagrado direito à terra. Portanto ele não declinará competência se não houver muita pressão. A união e ação da população de Jaru e Ariquemes e dos movimentos e pessoas verdadeiramente democráticos podem forçar o juiz.
Os camponeses são sabedores de seus direitos e da justeza de sua luta. Eles não estão dispostos a perder tudo o que construíram, não estão dispostos a ir pra cidade, amargar desemprego e fome e verem seus jovens caírem nas drogas. Eles vão resistir até as últimas conseqüências. Está na mão do juiz Danilo Paccini evitar mais um conflito pela terra em Rondônia.
