celebrated Heroicity Day, commemorating the rebellion of 34 years ago by the

Today as yesterday, in Peru, we denounce that the fascist,
genocidal and vendor country government of (Martín )Vizcarra, under the
leadership of the Yankee CIA, continues to implement the plan to assassinate
Chairman Gonzalo, with his absolute and perpetual isolation for nearly 28 years
now. The situation of Chairman Gonzalo, these days, is aggravated by the
danger of contracting the Corona Virus disease, due to his age and state of
health, he is highly vulnerable to the corona virus. The authorities of
the old State act with blind hatred and perverse homicidal fury against the
most important revolutionary political prisoner in the world, keeping him
prisoner in inhuman conditions, exposed to greater danger in the absence of any
control over the sanitary measures of his jailers at all levels.
In the face of the unstoppable, fierce resistance of
Chairman Gonzalo, in defense of the Party Headquarters and the revolution, the
government's plan to assassinate him continues to be covered through the game
of the judicial authorities and the criminal executors (Judicial Power, Navy
and INPE[1])
to delay the resolution of his situation to end the new certain and imminent
threat against his life.
We denounce the miserable revisionists and capitulators of
the LOD[2] at
the service of the CIA hoax-reaction against Chairman Gonzalo, who now present
themselves as defenders of their health and life. Being themselves, who
repeatedly denied the assistance of internationalist lawyers to Chairman
Gonzalo from the year 93 onwards, then from 2000 they spread through the media
at their disposal, that the campaign in defense of the health and life of
Chairman Gonzalo was unnecessary and they gave it finished, according to them
the genocidal state guaranteed it.
These same LOD rats, continuing their service to the
President's extermination plan, in January 2003 renounced filing the habeas
corpus action to end the confinement of Chairman Gonzalo and their own
imprisonment, confident in the promise of the reaction that they would come out
with the "new trials".
The situation that occurred was that the Constitutional
Court (TC) annulled the judgments and trials since 1992, which were followed
before the Military Court
and the "faceless judges", so that Chairman Gonzalo and all of them
remained in prison without court order or valid criminal law. Resolution
TC, de facto without expressly saying so, recognized the arbitrary nature of
his confinement. De jure everything acted since his arrest was
invalid. The old State took this measure through the TC to cheatly “comply”
with the norms of the Inter-American Treaty on Human Rights.
But, this same TC, chaired by the genocidal Alva Orelandini,
instead of ordering that the judges order the immediate release of Chairman
Gonzalo and other prisoners; In the same resolution, he ordered his stay
in prison, violating his "constitutional rights", prohibiting the
admission and judicial processing of habeas corpus so that the violation of the
freedom of the prisoners immediately ceases.
How did the LOD lawyers act in this situation? They
were complicit in procedural silence, confident in the reactionary offers of
freedom for everyone else except for the President. They did not file any
appeal against the violation of the rights of the President and other illegally
detained. With their silence they legitimized the beheading of habeas
corpus in defense of the President's freedom, in defense of his right to due
process, of the non-retroactivity of substantive, procedural and penitentiary
norms to the detriment of the President and, for his complicity and trust in
the enemy , themselves.
The attorneys and heads of the LOD acted knowingly that,
having filed the constitutional guarantee action and rejected by the judicial
authorities of the Peruvian
State
Furthermore, existing precedents, Case 11.166 IACHR, in
response to a complaint filed on April 22, 1993 for separation of office and
prohibition of Amparo by Judge Vásquez (Decree Laws Nº25423 and Nº 25454) ended
with the acceptance of the Recommendations formulated in Report N. 94-98 of
December 9, 1998 by the IACHR by the representatives of the State. The
Report concluded that the case was violated, among others, “… the right to
equality before the law and the right to judicial protection, such violations
also constitute a violation of the generic duty of the State to respect and
guarantee the rights of the persons who find under its jurisdiction." In
the case of the President, there was a more serious violation, that of his
freedom. Therefore, according to the IACHR, any prohibition to
exercise an action of constitutional guarantee has absolute nullity. But,
even more, one of the LOD lawyers declared at that time to Caretas magazine
that the President did not want his freedom but the rest of his
"co-defendants".
For all that, we denounce this proceeding of the lawyers and
heads of the LOD, they have never done anything for the defense of the health
and life of Chairman Gonzalo, rather as we justified they have opposed his fair
and correct legal defense and the national and international campaign. Now
they want to present themselves as the defenders of the President. On
behalf of the international proletariat and the peoples of the world, we call
on you to cease your attitude complicit in the CIA plan - the Peruvian reaction
to assassinate and defame him.
In Peru ,
the fascist, genocidal and vendor country government has failed in its three
reactionary tasks, the old society is in an advanced state of
decomposition. The alleged measures to combat the pandemic and the biggest
economic crisis so far have failed. Abandonment of public health,
collapsed hospitals, thousands of sick people suffering from the unspeakable
and others dying without the minimum healthcare.[3]
There is no oxygen for medical use, because the market is
monopolized by two Yankee companies that are authorized to produce medicinal
oxygen and the government does not allow companies that produce industrial
oxygen to produce oxygen for medicinal use (bureaucratic capitalism and
corruption).
The masses are desperate and ready to do anything to fight
for bread, their health, life, against the State and the system
itself. The masses cry out for the leadership of the PCP and the need to
develop the people's war.
The government and authorities of the old State, against its
own national and international norms and recommendations for the liberation
pandemic, relaxation of conditions and treatment of prisoners in general who
are the group at high risk for disease, age, etc., maintains invariable the
inhumane conditions of confinement with absolute isolation for more than 27
years of Chairman Gonzalo, exposed to imminent contagion by his jailers and
authorities. All with the endorsement and complicity of the "defenders"
of human rights and the organizations they represent, both from Peru and from
the rest of the world.
We denounce, once again, this plan of annihilation of the
Chief of the PCP and the Peruvian revolution by the reaction and imperialism
with the complicity of the heads and lawyers of the LOD. We call on the
international proletariat and the peoples of the world, the parties and
organizations of the MCI to denounce with all force this reactionary plan and
defend consequently and boldly Chairman Gonzalo, Head of the Party and the
revolution. Denouncing and urging all those who act in complicity with
this sinister plan to annihilate the old State and imperialism. Raise the
campaign to defend the health and life of Chairman Gonzalo to greater heights!
On this solemn occasion, we reaffirm ourselves in the
unwavering commitment to follow the shining example of the People's Heroes, the
glorious belligerent death of these prisoners of war is sheltered with the
blood already shed and before it the communists of the world assume the
unwavering commitment of follow his shining example, to start and develop the
